Tenancy Agreement

At the top of the list of documentation is your tenancy agreement. This will form the most important document in your position as a landlord, as it will also for your tenants.

Free to download from the UK Government website is a model Assured Shorthold Tenancy Agreement (AST). In this agreement, the rights of both yourself as the landlord and your tenants are drawn out clearly and concisely.

As the landlord, the most important aspect of the agreement is that you have the full right to repossess the property from your tenants at the end of the agreed term of tenancy.

You should know that there is neither a maximum or minimum term that needs to be specified in your AST. However, tenants have the right to remain in your property for at least six months from the date of first occupancy. Furthermore, if you both agree upon a fixed term of tenancy that exceeds a three-year period, then you will need to have a deed officially drawn up by a solicitor.

Should you ever decide to terminate an agreement, you are required to give your tenants at least two months’ prior notice.

The most important information that your Assured Shorthold Tenancy Agreement will contain includes the following:

  • Landlord’s full name

  • Tenant’s full name

  • Address of property

  • The date when the tenancy will commence

  • The duration of the tenancy

  • The amount of rent payable, including details of how and when it should be paid

  • What other payments are expected of the tenant, including utilities bills and Council Tax

Landlord Inventory

Of almost equal importance is the landlord inventory. It is on this document that you will itemise all of the contents of your property – complete with a detailed account of each item’s condition – prior to the commencement of the tenancy.

It’s important that you spend time over this document, and that you walk through it with your tenants upon arrival. Your tenants will need to agree to the landlord inventory and sign it, thereby acknowledging its accuracy. At any point during or at the end of the tenancy, this document may be used for reference to ascertain whether any of your property is damaged or missing. It is therefore important that your tenants are provided with their copy of the inventory to avoid any discrepancies at a later date.


Landlords will typically collect a deposit at the beginning of a tenancy. This money – usually equal to one month’s rent – will be repayable in full to the tenant upon the termination of the tenancy.

However, exceptions may be taken if any of the items on the landlord inventory are found to be missing or damaged beyond a reasonably expected amount of general wear and tear. In this case, or if the tenant leaves without paying a rent, then some or all of the deposit may be withheld by the landlord to cover any losses. Receipts must be provided to the tenant as evidence as to the costs of any repairs or replacements.

The landlord is also responsible for the health and safety of the tenant with regards to gas, electric and fire safety.
